Terms of service.

Your account

Keep your account information accurate and your API keys secret. Anything done with your keys counts as done by you, so revoke a key immediately from the dashboard if you think it has leaked. One account per person or organization; you must be legally able to enter into this agreement.

Acceptable use

Use the service lawfully and within the limits of your plan. Do not: circumvent or attempt to circumvent rate limits, quotas, or usage metering; share, pool, or resell API keys or access to the service; probe or disrupt the service's security or availability; or use automated means to create accounts. We may throttle or reject traffic that threatens the stability of the service for others.

The data

The elevation datasets we serve originate from public open-data programs (for example USGS, NRCan, and INEGI) and remain governed by their source licenses, including any attribution requirements those licenses carry. We do not claim ownership of the source data, and — subject to those source licenses — what you build from data you retrieve through Darly is yours. The service itself (the APIs, normalized catalog and metadata, documentation, and website) belongs to Darly and may not be copied or offered as a competing service.

Accuracy — read this one

Elevation data is derived from third-party surveys and models. It contains errors, gaps, datum differences, and artifacts, and values can change as sources are updated or re-ingested. The service is not suitable for safety-of-life or safety-critical uses — including aviation, navigation, emergency response, or as the sole basis for engineering or construction decisions. Verify independently before relying on any value where the consequences of an error are serious.

Plans, billing, and cancellation

Free-tier limits are described on the pricing page and may evolve. Paid plans are monthly subscriptions billed in advance and renew automatically. Payments are processed by Stripe; we never see or store your card details. Prices may exclude applicable taxes, which are calculated at checkout.

You can cancel any time from the billing portal; cancellation takes effect at the end of the current billing period, and we do not prorate partial months unless the law where you live requires it. Usage beyond your plan's quota is rejected or throttled — we do not silently bill overages. If we change prices or materially reduce what a plan includes, we will give you at least 30 days' notice before it affects you.

If you subscribe as a consumer in the EU, you ask us to start providing the service immediately; if you exercise your 14-day right of withdrawal, you are charged proportionally for the period already provided, as consumer law provides.

Availability and changes

We work to keep Darly fast and available, but unless your plan includes a written SLA the service is provided without an uptime guarantee. We may add, change, or retire features; if we discontinue something you depend on, we will give reasonable notice where practicable.

Termination

You can stop using Darly and delete your account at any time from the dashboard (see the privacy policy for what happens to your data). We may suspend or terminate accounts that break these terms, abuse the service, or fail to pay, with notice where practicable. Sections that by their nature should survive — including the data-license, accuracy, and liability sections — do.

Disclaimers and liability

The service and all data are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy. To the maximum extent permitted by law, Darly is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data; and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law.

Governing law

Darly is operated from France by Nicolas Brown (EI), trading as Darly Geospatial (see the mentions légales). These terms are governed by French law, with disputes belonging to the French courts — except where the consumer-protection rules of your place of residence give you rights that cannot be waived.

Changes and contact

If these terms change materially, we will note it here and email account holders at least 14 days before the changes take effect; continued use after that is acceptance. Questions go to [email protected].
